买as it is 仍有权知房屋历史 许多人以为买法拍屋就是买「当时状态」(as it is),意味着房子不论好坏,买主都须概括承受。但近日代表华人向卖方提起民事赔偿诉讼的的华裔房地产律师指出,根据加州法律,即使是法拍屋,买主在买屋前一样有权利获悉任何影响房价的事实。 曾担任地产经纪的房地产律师萧沛夫近日代表华人客户,向一家主流银行及代表该行处理一栋位于洛杉矶县境内之法拍屋的地产经纪提起告诉。理由是他的客户在买下法拍屋丶并完成产权移转手续后才发现,房子曾经栽种过大麻,并曾被洛县警局突袭。此外,该栋房子的阁楼也塞满垃圾,并有瓦斯漏气问题。 该宗诉讼要求被告赔偿300万元,以弥偿原告精神及物业价格将受影响的损失。 萧沛夫指出,根据加州民法及一般法,房子若曾发生过可能影响其房价的事实,卖方有责任告诉买方。他称,该案过去并无判例,有可能是类似情况的第一宗求偿案。 房子若过去三年曾有人死在里面,不管是自杀或自然死亡,卖方也有责任告知买方。 拥有多年经验的地产经纪王桂华说,卖方固有责任告知与房屋有关的各项事实给买方,但法律只规定「达到卖方知道的程度而已」。如果卖方根本不知道房子曾经有人栽种大麻,如何能在房屋过户前告诉买方呢! 她表示,这种情况并非毫无前例,如曾代客户出价的一栋法拍屋,在出价后第二天,卖方经纪才致电给她,表示才收到市府通知,指称该栋房屋有许多水电设备并无市府许可。经她追查才发现该栋房子曾经栽种过大麻,以致出现市府未核准的水电等设备。但在她发现以前,卖方也毫不知情。 来源:World Journal |
