[7/14/10] 抢购法拍屋当心列黑榜 法拍屋大多比市价低,手边有闲钱的华人对投资法拍屋一向极有兴趣。过来人称,购买法拍屋须快、狠、准,即令是有经验的投资者,最好还是找一名有经验的地产经纪,将可免去一些不必要的风险。 对投资法拍屋有心得的富乐顿吴先生指出,目前信息发达,想找法拍屋资料,不妨花一点钱订阅一些专门网站。不少地产经纪也花钱订阅,也可向他们请教,将省下不少时间。 法拍屋并分法拍前期屋(Pre-foreclosure)、拍卖屋(auction)及银行回收屋(REO)。 地产经纪林昌源指出,法拍屋是强制拍卖贷款违约的产物。依照加州法律并分法院拍卖(Judicial Foreclosure)和非法院拍卖(Non-Judicial Foreclosure)。 前者拍卖金额若不足偿还本来贷款,尚须经由法院取得缺额裁决(Deficiency Judgment),以便另外再向贷款人求偿。透过这项做法要八个月到三年之久,由于费用高昂,加上债务人此时差不多山穷水尽,较少被采用。 加州大多采信托拍卖,即由信托公司在法院门前拍卖拍卖屋。如果拍卖成功就成为所谓法拍屋;若失败,产权由债权人(银行)拿走,并产生银行回收屋(REO)。透过信托拍卖,程序往往几个月就完成,费用也较便宜。 购买方式是由本人或委托经纪带著现金支票参加竞标,并先向债权公司派出或委托拍卖的拍卖官登记。 得标后,将支票背书给拍卖公司,支票面额须等同或高于得标金额。若不足得标马上失效,且会被认为明知金额不足又去抢标,将被列为黑名单,永远被禁止参加竞标。 林昌源建议,不妨手边多准备几张不同面额的现金支票。如果提供的支票金额超过标价,拍卖公司将在七个工作天内寄回溢额。拍卖官也会当场开立收据,并于七个工作天内寄来产权让渡书以供登记。 地产经纪刘莉莉说,除非打算全部用现金买,否则法拍屋会要求买方提供银行或贷款公司预先批准的证明书,如果未预做准备,即使看到中意的房子,也无法出价。而法拍屋过户时间较短,若资金无把握,却贸然行事,将被没收定金。 世界新闻网-洛杉矶 |
